Abstract. This article describes the increasingly intense interrelationship between protection of property rights and the quality of human capital in the modern economy. In accordance with the requirements of the law of requisite diversity and within the framework of the systems paradigm methodology, an analysis of protection of property rights is proposed as a specific space-time continuum, encompassing the dynamic interrelationships of the subsystems of an object, process, environment, and project. The necessity of establishing basic forms of ownership (personal, private, and common) is demonstrated. This constitutes the most important foundation for ensuring sustainable protection of property rights, as well as overall high institutional efficiency of the economy. It is shown that, under conditions of hypertrophy of private ownership, a system of “quasi-private” power ownership naturally emerges as the basis for extractive institutions and a social order of limited access, which do not ensure high transactional efficiency of the economy. The article substantiates the conclusion that the low level of protection of property rights in the modern Russian economy is a natural consequence of its falling into an “institutional trap” that hinders the effective development of human capital and the entrepreneurial activity of society. General foundations are developed for the establishment of a new political-economic order of human cooperation in our country, designed to prioritize inclusive institutions and, consequently, ensure a high level of protection of property rights.
